Information and consultation Regulations

The European Union Directive for informing and consulting employees will give employees the right to be:

  • informed about the business's economic situation
  • informed and consulted about employment prospects, and
  • informed and consulted about decisions likely to lead to substantial changes in work organisation or contractual relations, including redundancies and transfers.

Employers and employees may meet their obligations by means of existing agreements on information and consultation.

Implementation will be in stages - businesses with 150 employees or more (March 2005), businesses with 100 or more employees (2007) and businesses with 50 or more employees (2008). The Directive does not apply to those businesses with fewer than 50 employees. We have plans to run a series of seminars covering this regulation and how a pro-active approach will benefit your organisation. If you are interested please contact us.

 

Illegal Workers: Changes to Asylum & Immigration Act 1996

By now most businesses will have received a booklet from the Home Office outlining the changes to the Asylum and Immigration Act 1996 coming into force on 1st May 2004.

 

We strongly recommend that all organisations regardless of size and industry sector adhere to this requirement to ensure that they are only employing those who are able to work legally here, and that organisations do not place themselves at risk of committing a criminal offence or discriminating on racial grounds.

 

This change will have an impact on your recruitment procedures. The change required is not too onerous, however you will need to ensure that all the people in your organisation who are responsible for recruitment are aware of the new requirements and what procedure they need to follow.
