Choosing a Mediator

The success of mediation can rest on the mediator you choose. Mediators come with a range of backgrounds and experience so what should you look for?

Here are ten must ask questions that we at PicassoHR consider important.

Ask yourself for workplace mediation:

  1. Do they have the necessary professional experience and background in HR and/or employment law?
  2. What is their level of experience and technical knowledge?
  3. Will their style and personality suit the conflict situation? Do they have an air of authority, an empathetic communication style? Will they use these to possibly help a stubborn party or parties move towards settlement? Are they willing to work late?
  4. What is they experience of dealing with highly charged situations?
  5. What are their qualifications and accreditation and were they obtained from a reputable institute such as the Institute of Arbitrators?
  6. Do they have independent references?
  7. What code of conduct do they follow if any, such as the European code of conduct?
  8. How far are they willing to travel?
  9. What is their availability and fees?
  10. Have they met with or at least had a telephone conversation with each party and are both parties happy to use them? This is crucial.
